In exercise of the power conferred by clauses (e), (f), (g), (h) [and (i)] of sub-section (2) of section 30 of the Maharashtra Medical Practitioners Act, 1961 (Maharashtra XXVIII of 1961) and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, after previous publication, makes the following rules, namely:-1. Short title. – These rules may be called the Maharashtra Medical Practitioners’ (Registration) [* * * * *] Rules, 1961.2. Definitions. – (1) In these rules, unless the context otherwise requires, –

(a) “Act” means the Maharashtra Medical Practitioners Act, 1961 (Maharashtra XXVIII of 1961);

(b) “Form” means a form appended to rules;

(c) “Section” means a section of the Act;

(d) “Committee” means the Committee appointed under subsection (6) of section 17.(2) The words and expressions used in these rules but not defined therein shall have the meaning respectively assigned to them in the Act.3. Further particulars to be included in register [* * * * *]. – The register [* * * * *] to be prepared and maintained under the Act shall include the following further particulars, that is to say,-

(a) Registration [* * * * *] number;

(b) Nationally of the practitioner;

(c) if the practitioner is a married woman, her maiden name and surname;

(d) Date and the place of birth of the practitioner;

(e) in cases where a practitioner is registered under sub-section (4) of section 17, the register in which his name stood registered on the day immediately before the appointed day;

(f) in cases where a practitioner is registered under sub-section (5) of section 17, the clause of the said sub-section under which he has been registered;

(g) [* * * * *]

(h) date of renewal of registration [* * * * *] of the practitioner ;

(i) if any disciplinary action is taken by the [Council] against the practitioner, the particulars of such action;

(j) if the name of the practitioner was removed from the register [* * * * *] and subsequently reentered therein, the date on which the name was so re-entered.4. Application for registration. – (1) Every practitioner desiring to have his name entered in the register [under sub-section (3) of clause (i) or (ii) of subsection (5)] of section 17 shall apply to the Registrar in Forms ‘A’ and ‘B’ respectively, which shall be obtained from the Registrar, The Registrar shall comply with any requisition for the supply of forms.[(1A) Every practitioner desiring to have his name entered in the register under clause (iii) of sub-section (5) of section 17 shall apply to the Registrar in Form ‘BB’.](2) Every application made under sub-rule (1) shall be accompanied by –

(a) Registration fee of rupees ten; and [if it is an application under sub-section (3) of section 17 made on or after the 11th day of February 1972, a fee of rupees fifty, and]

(b) Birth certificate or matriculation certificate or S.S.C, Certificate or School Leaving Certificate, in original, together with two copies there of.(3) Every application for registration under sub-section (3) of section 17 shall also be accompanied by the diploma or certificate in original, in respect of the qualification of the application together with two copies of such diploma or certificate.(4) Every application for registration [under clause (i) or (ii) of sub-section (5)] of section 17 shall also be accompanied by

(a) a declaration [in the relevant form set out in the accompaniment to Form ‘B’] made by the applicant before a presidency Magistrate or an Executive Magistrate not below the rank of Taluka Magistrate to the effect-

(i) that the applicant had been regularly practicing the Ayurvedic or the Unani System of Medicine in the Vidarabha region or the Hyderabad area of the state, for a period of not less than ten years immediately before the 23rd day of November, 1960; or

(ii) that he was on the 4th day of November 1941 regularly practicing the Ayurvedic or the Unani System of Medicine in the Bombay area of the State, but his name was not entered in the register maintained under the Bombay Medical Practitioners Act, 1938;

(b) A certificate [in the form set out at the end of the accompaniment to Form ‘B’] signed by any Gazetted Officer of the State Government or by a Justice of the peace to the effect-

(i) that the applicant had been regularly practicing the Ayurvedic or the Unani System of Medicine in the Vidarbha region or the Hyderabad area of the state, for a period of not less than ten years immediately before the 23rd day of November, 1960; or

(ii) that he was on the 4th day of November, 1941 regularly practicing the Ayurvedic or the Unani System of Medicine in the Bombay area of the State, but his name was not entered in the register maintained under the Bombay Medical Practitioners Act, 1938;

(c) any other documentary evidence such as rent receipts in respect of the dispensary or clinic or place of practice of the applicant, old prescription papers, receipts, or cash memos in respect of medicines or drugs purchased by the applicant, which the applicant wants to adduce in support of his claim for registration.[(5) Every application made under clause (iii) of sub-section (5) of section 17 shall be accompanied by registration fee of rupees ten and the testimonial of enlistment issued to the applicant in pursuance of rule 102A of the Bombay Medical Practitioners’ Rules, 1939, together with two copies there of.][(6)(a) Every practitioner desiring to have a provisional registration in the register under sub-section (1) of section 18A shall apply to the Registrar in from ‘BC’ which shall be obtained form the Registrar. The Registrar shall comply with any requisition for the supply of forms.(b) Every application made under clause (a) shall be accompanied by-(i) Registration fee of rupees fifteen;(ii) Birth certificate or matriculation certificate or S.S.C Examination certificate or school Living certificate or Domicile certificate or an extract from the passport in original;(iii) Certificate of passing the qualifying examination in original;

(iv) Certificate from the Head of [approved Institute] where the applicant has been admitted for internship training.][(7)(a) Every practitioner who desires to have fresh certificate of registration under subsection (2) of section 23A shall apply to the Registrar in from ‘N’ which shall be obtained form the Registrar. The Registrar shall comply with any requisition for the supply of forms.(b) Every application made under clause (a) shall be accompanied by-(i) fees of rupees five;

(ii) The certificate of registration in original.][5. Application for certificate of Registration. – (1) Every practitioner desiring to have a certificate of registration under sub-section (2) of section 18, shall apply to the Registrar in form ‘C’ which shall be obtained from the Registrar. The Registrar shall comply with any requisition of forms.(2) Every application made under sub-rule (1) shall be accompanied by(a) Registration fee of rupees fifteen;(b) Birth certificate or matriculation certificate or school leaving certificate in original together with the copies there of

(c) Certificate of enlistment in original.]6. Enquiry by Committee. – (1) The Committee shall consider each application received under rule 4 and 5. Any application which does not satisfy the requirements of those rules shall be rejected by the Committee. The question of registration [* * * * *] in respect of each application shall be decided in accordance with the opinion of the majority of the members of the Committee.(2) For the purpose of making enquiry in respect of any such application, the Committee may, if it considers necessary, direct the Registrar to call any applicant for interview at the applicant’s cost, or may refer any application –

(a) to the Collector of Bombay, if the applicant claims to be practicing any system of medicine (other than the Homoeopathic or Biochemical system of medicine) in Greater Bombay, or

(b) to the collector of the District concerned, if the applicant claims to be practicing such system outside Greater Bombay, for verification of such facts mentioned by the applicant in the application, as the Committee may specify in that behalf.7. Certificates of registration and [provisional registration.] – The certificates of registration and [provisional registration.] shall be Forms ‘D’ and ‘E’ respectively. The certificate of registration shall be printed on white paper and the certificate of [provisional registration.] shall be printed on blue paper.[7A. Forms of Duplicate Certificate and fee in respect there of. – (1) The duplicate certificate of registration and [provisional registration.] shall be in forms ‘D’ and ‘E’ respectively, with the words ‘Duplicate’ clearly stamped thereon in red ink.(2) The fee for a duplicate certificate of registration or provisional registration shall be rupees five.]8. Maintenance of register [* * * * *]. – Each page of the register [* * * * *] shall be verified by the Registrar’s signature and each entry in the register [* * * * *] as respects particulars specified in clause (h), (i) or (j) of rule 3, shall be attested by the initials of the Registrar.9. Making new entries or altering existing entries in register [* * * * *]. – (1) Any registered [* * * * *] practitioner who under section 21, desires

(a) to have the entry as respects his name in the register [* * * * *] altered; or

(b) to have an entry as respects any additional qualification acquired by him subsequent to the date of his registration [* * * * *] in the register [* * * * *]; or

(c) to have any alteration made in the entry as respects his additional qualifications in the register [* * * * *]may make an application in that behalf to the Registrar.(2) The application made under sub-rule (1) shall be accompanied by a fee of rupees five.(3) On receipt of the application and the fee, the Registrar shall alter or make any entry as applied for;Provided that no entry as respects additional qualification shall be made in the register unless a person possessing such qualification is entitled to have his name entered in the register under sub-section (3) of section 17.10. Change of address to be intimated to the Registrar. – It shall be the duty of every registered [* * * * *] practitioner who changes his address to intimate such change of address to the Registrar within one month of such change.[11. Forms of notices and applications etc. under section 23A (1) (a). – (1) The first general notice and the second general notice referred to in sub-clause (i) of clause (a) of sub-section (1) of section 23A shall be in form [F and G respectively.](2) The general notices referred to in sub-rule (1) shall also be published in at least one newspaper in English, Marathi, [and Hindi having wide circulation in the region.](3) The individual notice referred to in sub-clause (ii) of clause (a) of sub-section (1) of section 23A shall be in [Form H] and the form of application required to be enclosed therewith shall be in [Form J].(4) The individual notice referred in sub-clause (ii) of clause, (a) of sub-section 23A, shall be in [Form J] and the application required to be enclosed therewith shall be in [Form K].]12. Other manner of publication of fact of removal of name from Register. – (1) The fact of the removal of the name of any defaulting practitioner from the Register under sub-clause (iv) of clause (a) of sub-section (1) of section 23A shall also be published in at least one newspaper [in English, in Marathi and one in Hindi having wide circulation in the region.](2) The fact of such removal of name from the Register shall also be communicated to the District Magistrate, Superintendent of Police and the Inspector of Police, having jurisdiction over the area in which the defaulting practitioner resides, and also to the Commissioner, Food and Drugs Administration, Maharashtra state, the Maharashtra Medical Council and such other bodies as the Board may decide.13. Manner of withdrawal of cancelled certificate. – Where a certificate of registration is deemed to be cancelled and is liable to be withdrawn from a practitioner under sub-clause (iv) of clause (a) of sub-section (1) of section 23A, the District Magistrate or any person duly authorized by him in this behalf, shall at the request of the Registrar arrange to withdraw such certificate from the practitioner concerned and after he has taken it in his possession, forward the same to the Registrar.14. Period of limitation for application for re-entering name in Register. – The period within which an application for re-entering the name removed from the Register under sub-clause (iv) of clause (a) of subsection (I) of section 23A, may be made, shall be three months from the date on which the name of the defaulting practitioner was removed from the Register.[15. Procedure for continuance of name of practitioners on Register. – For the purposes of clause (b) of sub-section (1) of section 23A the forms of the two general notices referred to therein shall be in the From ‘FF’ and ‘GG’ respectively appended hereto and the other manner of publishing such notices shall be the same as are mentioned in rule 11 with such modifications as may be necessary and the provisions of rule 12, 13 and 14 shall mutatis mutandis apply in relation to the continuance of the names of the registered practitioners on the Register.]16.[* * *][16A. Forms of notice and application under section 23A(1)(c). – The notice referred to in clause (c) of sub-section (1) of section 23A shall be in [Form L] and the application to be enclosed therewith shall be in [Form M].]
